Child custody can be determined either by status quo, which is what is the situation at the time of separation. Or when you go into court, the court's going to look more at who's the primary parent doing the primary roles for the child. The one piece of advice I often give my clients is that they have to push emotions aside. You have to focus on moving on with your life and dividing up your assets. If there are children involved, it's more important that you focus on their needs than your own.
The thing that I enjoy about family law is that I can step into someone's shoes that is very emotional and not able to focus on the actual legal aspects of a marriage.
